No person shall knowingly use any kind of electric current, explosive substance or poisonous substance in or around such water with the intention of catching and killing any waterfowl in any water. However, this section and nothing under this section shall not prevent the owner of a private water from using any method other than the release of poisonous substances to catch and kill waterfowl in his private water so as not to harm the waterfowl of any other water.
